User Agreement

This User Agreement governs your use of the Creative Catalyst Collective Portal (“CCC Portal”), an organization-specific portal used by Creative Catalyst Collective, Inc. (“CCC,” “we,” “us,” or “our”) to administer registrations, programs, payments, donations, forms, and communications.

The CCC Portal is hosted and operated through the NPressive platform. Your use of the underlying platform is also subject to NPressive’s applicable Terms of Use and Privacy Policy. This User Agreement governs your relationship with CCC and your use of the CCC Portal specifically.

1. Adult Account Holder
You must be at least 18 years old and legally authorized to enter into this agreement. When registering a student, you certify that you are the student’s parent or legal guardian, or that you otherwise have legal authority to register the student, provide information about the student, make program selections, and provide required permissions on the student’s behalf. Students may be listed as program participants but may not independently create an account, accept this agreement, or provide legally required permissions.

2. Account and Registration Information
You agree to provide accurate, current, and complete information and to update it when necessary.

You are responsible for:
- maintaining the confidentiality of your account credentials;
- activity conducted through your account;
- ensuring that you are authorized to provide information about each student registered through your account; and
- promptly notifying CCC of material changes to contact, emergency, medical, allergy, pickup, or other information relevant to a student’s participation.

You may not create an account using false information, impersonate another person, or access another person’s account without permission.

3. Use of Student Information
By submitting information about a student, you certify that you have authority to provide that information to CCC for purposes related to:
- registration and enrollment;
- program administration;
- student safety and emergency response;
- communications with parents or guardians;
- payments and financial administration;
- auditions and team-placement decisions;
- compliance with program, school, insurance, or legal requirements; and
other purposes reasonably necessary to operate CCC programs.

CCC’s handling of information through the portal is also subject to the applicable NPressive Privacy Policy and any additional privacy notice provided by CCC.

4. Program-Specific Agreements
This User Agreement governs use of the CCC Portal. It does not replace the terms applicable to a particular program, event, audition, team, workshop, or activity.

A registration may require separate acceptance of terms concerning:
- parent or guardian consent;
- assumption of risk and release of liability;
- emergency medical authorization;
- student conduct;
- fees and refunds;
- attendance and pickup;
- auditions and team placement; and
- optional photography or media permissions.

Those program-specific terms are incorporated into the applicable registration. If they conflict with this User Agreement, the program-specific terms control for that program or activity.

5. Registrations and Program Placement
Submitting a registration does not guarantee enrollment, admission, audition selection, competition-team placement, a particular coach, schedule, role, or continued participation unless CCC expressly confirms otherwise. CCC may establish eligibility requirements, enrollment limits, deadlines, auditions, attendance expectations, conduct standards, and other reasonable program requirements. CCC may correct registration errors, reject incomplete or unauthorized registrations, place participants on a waiting list, or cancel a registration when reasonably necessary.

6. Payments and Donations
You authorize CCC and the payment processor available through the portal to process payments or donations that you knowingly submit. Program fees, refund terms, installment obligations, and other payment conditions are governed by the terms disclosed during the applicable registration or transaction.

Unless expressly stated otherwise in a program registration:
- submitting payment does not guarantee team placement or selection;
- donations are voluntary and do not influence placement decisions; and
- donations are separate from required program fees.

7. Communications
You authorize CCC to use the contact information you provide for communications reasonably related to:
- your account;
- registrations and payments;
- program schedules and changes;
- student attendance, conduct, health, or safety;
- auditions and team placement;
- volunteer and tournament requirements; and
- other CCC operational matters.

You are responsible for maintaining an email address and telephone number that CCC can use to reach you.

8. Appropriate Use
You may use the CCC Portal only for legitimate purposes related to CCC programs and activities.

You may not:
- provide false, misleading, or unauthorized information;
- register a student without legal authority;
- misuse information concerning another student, family, coach, volunteer, or participant;
- attempt to interfere with portal access or operations;
- use the portal to harass, threaten, solicit, or impersonate another person; or
- use CCC registrations, directories, communications, or participant information for unrelated commercial or personal purposes.

9. Account Restriction or Termination
CCC may restrict or terminate access to the CCC Portal, reject or cancel a registration, or require corrections to account information when reasonably necessary because of:
- inaccurate or unauthorized information;
- misuse of the portal;
- security or privacy concerns;
- nonpayment;
- violation of this User Agreement or program terms;
- unlawful conduct; or
- conduct that threatens students, families, coaches, volunteers, CCC, or its programs.

Termination of portal access does not cancel payment or other obligations already incurred under an applicable registration.

10. Electronic Acceptance
By creating an account, selecting the required acceptance option, or continuing to use the CCC Portal, you certify that:
- you are at least 18 years old;
- you have authority to enter into this agreement;
- you have read and understand this User Agreement;
- the information you submit is accurate and authorized; and
- you agree to be bound by this User Agreement.

You understand that your electronic acceptance has the same legal effect as a handwritten signature. Georgia law generally recognizes that electronic records, contracts, and signatures may not be denied legal effect solely because they are electronic.

11. Changes to This Agreement
CCC may update this User Agreement when reasonably necessary to reflect changes in its programs, portal use, or organizational practices. Material changes will be presented through the portal or communicated by another reasonable method. When renewed acceptance is required, continued access may depend on accepting the updated agreement.

12. Governing Law
This User Agreement is governed by the laws of the State of Georgia. If any provision is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Event Waiver

**Parent/Guardian Consent, Assumption of Risk, and Medical Authorization**
I certify that I am the parent or legal guardian of the student being registered, or that I have legal authority to register the student and provide the permissions contained in this agreement.

I give permission for the student to participate in the Intro to Odyssey of the Mind program operated by Creative Catalyst Collective, Inc. (“CCC”). I understand that activities may include creative problem-solving exercises, games, movement, teamwork, crafts, construction, and the use of age-appropriate tools and materials, including scissors, glue guns, hand tools, cardboard, wood, paint, adhesives, and fasteners, as well as food and snacks and other supervised indoor or outdoor activities.

Acknowledgment and Assumption of Risk:
I understand that participation involves ordinary risks, including slips, falls, collisions, minor cuts, splinters, burns, allergic reactions, contact with tools or materials, and other injuries that can occur during student activities. I voluntarily permit the student to participate and knowingly accept these risks.

I agree to disclose any medical condition, allergy, physical limitation, behavioral consideration, or other information that CCC should reasonably know to provide appropriate supervision and respond to an emergency.

Release of Liability:
To the fullest extent permitted by Georgia law, I release and agree not to hold liable Creative Catalyst Collective, Inc.; its board members, coaches, instructors, volunteers, and contractors; Montgomery Elementary School PTO; and the applicable school or school district for claims arising from the ordinary risks of participation or from ordinary negligence.

This release does not apply to gross negligence, reckless or willful misconduct, intentional wrongdoing, or any liability that cannot legally be waived.

I understand that this agreement is intended to release both claims I may have personally and, only to the extent permitted by law, claims arising through the participating student.

Emergency Medical Care:
If I cannot be reached during a medical emergency, I authorize CCC personnel, coaches, instructors, and volunteers to obtain or arrange reasonably necessary emergency medical care for the student, including contacting emergency medical services and transporting the student to an appropriate medical facility.

I understand that CCC personnel and volunteers are not medical professionals and cannot guarantee medical outcomes. I accept responsibility for medical expenses incurred on behalf of the student, except to the extent another person or organization is legally responsible for those expenses.

Student Conduct and Participation:
I understand that students are expected to follow safety instructions, respect other participants and property, and participate without substantially disrupting the program. CCC may contact me and require early pickup, suspend participation, or dismiss the student when reasonably necessary to protect the safety of participants or the effective operation of the program.

Fees, Withdrawal, and Program Changes:
I understand that the registration fee reserves a limited program space and covers staffing, materials, supplies, snacks, apparel, and other program costs. All fees are nonrefundable. If CCC cancels the entire program, the registration fee will be refunded.

CCC may make reasonable changes to activities, instructors, rooms, or schedules because of safety, facility, staffing, weather, or other operational needs.

Electronic Acceptance:
By selecting the required opt-in and submitting the registration, I certify that I am the student’s parent or legal guardian, or otherwise have legal authority to provide consent. I acknowledge that I have read, understand, and agree to the Parent/Guardian Consent, Assumption of Risk, Release of Liability, Medical Authorization, and Program Terms above. I also certify that the information I provided is accurate and complete, and I understand that my electronic acceptance has the same effect as my handwritten signature.
